Passed on the sign "No entry": a fine or a warning, when can I pass? How will you be punished for ignoring the traffic sign? Driving under the traffic sign is prohibited

The law establishes the rules of the road, which are binding. Among them stands out a group of signs that prohibit passage or entry in certain places.

Each driver should understand what they mean, who they apply to, whether there are exceptions, and what punishment will follow for their violation.

One of the most significant in traffic rules is the sign "Movement is prohibited". To avoid unpleasant situations, it is necessary to understand not only the scope of its application, but also what kind of fine for driving under the “Movement is prohibited” sign awaits each violator.

Compliance with the rules will avoid a huge number of various complications with law enforcement agencies.

The sign "Movement is prohibited" belongs to the group of prohibition signs. It marks those sections of the road and territory on which movement is prohibited for any vehicles.

It differs from the No Entry sign in that it is never placed on a one-way section of road before a turn. This must be distinguished, since many confuse the meanings of similar signs.

This sign has a round white color with a red border around the perimeter. The sign restricts traffic in both directions, both in oncoming traffic and on the way.

In most cases, the “Movement is prohibited” sign is installed in such cases:

  1. In order to indicate to drivers the presence of a zone for pedestrians on a given stretch of road. Most often, when they block the street on the occasion of some festive event.
  2. In case of damage to the roadway due to repair robots.
  3. Sometimes it is installed together with the sign "Dead end" at the entrance to the yards.
  4. Before entering closed areas of enterprises.

Quite often, sign 3.2 - “Movement is prohibited” is installed along with signs showing arrows pointing to the right, left, or both directions.

They indicate the direction where the given sign operates. For example, movement to the left may be prohibited on weekdays, and movement in both directions on holidays and weekends.

There are some categories to which the sign does not apply. Entry under the sign "Movement is prohibited" can be carried out by:

Nothing is said about other vehicles in the SDA. So, the effect of the prohibition sign applies to them.

Regarding public transport and the disabled, everything is clear at once. But as for the vehicles residing in the zone of the sign, as well as serving enterprises, one should understand in more detail.

After all, breaking the rules, it is not enough just to tell the traffic police inspector that the driver’s place of residence is somewhere behind the sign.

For confidence and peace of mind, you must have supporting documents with you. This may be an identity card with a residence address or a delivery note with the address of the recipient in the area of the mark.

Without supporting documents, the driver can be fined. The traffic police inspector cannot guess whether the driver has the opportunity to pass under the sign or he simply violates.

Article 12.16 of the Code of Administrative Offenses of the Russian Federation regulates the fine for violation of the requirements of signs and markings in 2020. It is in it that the sizes of fines are indicated for possible violations of the “Movement is prohibited” sign.

Its first part is intended for cars, and 6 and 7 for trucks.

In accordance with the above article, the minimum fine for driving under the “Movement is prohibited” sign in a car or truck is 500 rubles. In some cases, you can simply receive an official warning.

The relative ease of punishment is explained by the fact that traffic is prohibited on this section of the road and the driver cannot create obstacles in the movement of any vehicles.

But for such a violation in cities of federal significance, the amount of the fine can increase to 5,000 rubles, which will significantly hit the violator's pocket.

There is such a concept associated with the “Movement is prohibited” sign as “through passage” - it prohibits movement along the entire section of the road.

In the event that the driver needs to drive in without leaving the zone of the sign on the opposite side, he will not be fined if he comes up with a serious reason and can document it.

In 2016, changes were made to the legislation that make it possible to receive a discount on fines. This discount does not apply to all traffic police fines, but Article 12.16 of the Code of Administrative Offenses of the Russian Federation falls under these conditions.

This means that if you violate the requirements of the sign prohibiting movement, you can pay a fine with a 50% discount.

Compliance with payment deadlines plays an important role. It is necessary that the fine be registered in the traffic police database, this is approximately three days from the date of the decision.

In addition, payment must be made no later than 20 days from the date of the decision.

Prohibition sign 3.2 prohibits the movement of vehicles in certain cases. It applies to traffic in both directions. Therefore, it is not installed on one-way roads.

The punishment for driving under the sign "Movement is prohibited" is not the most severe. This is a minimum fine of 500 rubles, and sometimes you can just earn a warning..

Like every sign, this one also has its own exceptions, according to which, its effect is canceled.

A transport driver who has the right to drive under a prohibition sign must have with him the appropriate documents that prove this. Otherwise, the inspector may impose a fine.

When entering a residential area, you should carefully check the presence of a restrictive road sign. While the fine for a no traffic sign isn't that big, it's best not to get yourself in trouble. After all, you have to spend time communicating with the traffic police inspector and pay a fine. And if the money is transferred through a bank branch, then it will take at least 15-20 minutes. In case of untimely repayment of the recovery of the car owner, other problems await: the debt is transferred to the bailiff service, which may threaten the arrest of the bank account.

The pointer in the form of a white circle with a red frame is well known to every motorist. This sign restricts traffic within a residential area or on a specific section of the street. In some cases, the index 3.2 (according to the classification of traffic rules) is supplemented with plates 8.4.1 - 8.4.8. Each of them indicates the type of transport that is subject to the ban. If the side passage under the sign "Movement is prohibited" is limited, then the sign 3.2 is supplemented with one of the plates 8.3.1 - 8.3.3.

Area of effect

The entry ban is set as needed. Sometimes the city (district) transport department decides to install a sign on the bridge where it is necessary to restrict the movement of freight transport. In some cases, the sign is placed in front of residential areas to reduce traffic. Depending on the sign that supplements pointer 3.2, each vehicle receives a permit or, conversely, a ban on entry.

Among the most common cases of setting the “Movement prohibited” sign are:

  1. adjoining territories and residential microdistricts;
  2. carrying out road repairs;
  3. celebratory or sporting event requiring restriction of traffic (temporary installation of a sign);
  4. territory of enterprises.

Who is allowed to travel

As in some other situations, the introduced restrictions allow exceptions to the rules. They can refer both to the time of the sign, and to modes of transport. In particular, the exceptions for the No Passage sign apply to the following types of vehicles:

  1. regular buses, trolleybuses, trams, fixed-route taxis;
  2. transport of the Russian Post;
  3. personal cars of residents of houses located in the area of sign 3.2;
  4. cars owned by citizens with disabilities, or persons who are engaged in their transportation.

Differences between the signs "Movement prohibited" and "Entry prohibited"

It is no secret that some road signs have a similar meaning, only minimally differing from each other. But this does not mean that drivers can violate the ban, justifying their decision with minor differences. As a result, the traffic police inspector will always be right, and the car owner will be forced to pay a fine.

What is the difference between a “Movement prohibited” sign and a “No entry” sign? At first glance, there is no difference. But it is not so. Signpost 3.2 is never placed on a one-way road before a turn. Whereas (sign 3.1) can be obtained in a much wider list of cases. In this case, the administrative punishment here will be much more severe.

Fines in 2019

Violation associated with entry into the zone of validity of sign 3.2 is determined in accordance with Article 12.16 of the Code of Administrative Offenses of the Russian Federation. It should be noted that this article has separate paragraphs (6 and 7), which indicate the penalty for owners of trucks.

The fine for driving under the “Movement is prohibited” sign for drivers of passenger cars is determined in accordance with the Code of Administrative Offenses. It allows not only the imposition of a monetary penalty, but also a warning, as an alternative measure of responsibility. The decision on what type of punishment will be applied to the driver is determined by the traffic police inspector.

Behind the sign "Movement is prohibited"

It is in the interests of every motorist to know the exact amount of the administrative penalty that threatens for a particular violation. According to paragraph 1 of article 12.16, the fine for the “Movement is prohibited” sign in 2019 is 500 rubles. As in a number of other cases, this traffic violation is subject to a 50% discount on the payment of an administrative penalty. If the driver decides to pay off the fine no later than 20 days from the date of issuing the protocol, then instead of 500 rubles, he will have to lose only half of this amount.

For the sign "Movement of trucks is prohibited"

Unlike passenger cars, large-tonnage vehicles cause much more damage to the road surface. That is why the legislation for such violations increased the amount of the monetary penalty.

Waiting for drivers? The Code of Administrative Offenses of the Russian Federation applies here. In Moscow and St. Petersburg, the fine is 5,000 rubles, in other settlements - 500 rubles.

The specified administrative penalty applies only to the violation associated with unauthorized entry into the zone of action of the road sign 3.2. and legal entities are determined by . It assumes that the amount of the penalty will be assigned based on the results of determining the mass for each axle.

For the sign "Movement is prohibited for mechanical transport"

Sometimes the restriction on entry may only apply to cars and motorcycles. At the same time, for horse-drawn carts, bicycles, as well as for mopeds or scooters with an engine capacity of not more than 49.9 cubic meters. see ban does not apply. For such situations, a special sign 3.3 is installed, which restricts the entry of any mechanical transport, with the exception of the ones already listed, as well as Russian Post cars, disabled people and persons serving them.

Administrative punishment for violation of the rules of movement is determined according to paragraph 1 of article 12.16 of the Code of Administrative Offenses. This item involves the recovery of 500 rubles.

If the driver does not agree with the fine

The current legislation does not restrict citizens in the right to protect their interests. This applies equally to both criminal and administrative offences. A driver can appeal a fine for driving under a prohibition sign in one of two ways. The first involves filing an application with the traffic police department, the second option involves drawing up a lawsuit.

Faced with an unlawful fine or violation of the protocol, drivers, as a rule, turn to the traffic police. Filing a statement of claim is inappropriate due to the insignificance of the punishment and the length of the consideration procedure.

When drawing up a complaint, it should be noted that it must be registered no later than 10 days from the date the fine was issued. Otherwise, the penalty comes into force, and it will no longer be possible to appeal it.

The sign "Movement is prohibited" refers to a category in the traffic rules. This sign is the second most important prohibition sign and is numbered 3.2 after all (No Entry). It is a round disk with a white field, bordered around the circumference by a red stripe. The sign is intended to indicate territories and places where entry is prohibited for all types of transport.

Moreover, unlike the “brick”, it prohibits movement in the given territory in both directions. Therefore, it is not installed at intersections before crossing a street with one direction of movement. "Kirpich" prohibits entry to the road section from the specified direction. That is, if desired, the driver can drive into this area from another direction. But if there is a sign “Movement is prohibited”, then the movement of vehicles on this section of the road is prohibited, with the exception of certain categories of transport.

Sign action. Exceptions for vehicle categories

  • to designate a pedestrian zone on a certain section of a street or carriageway;
  • to block traffic during public events;
  • to block traffic for the period of repair work on the road;
  • at the entrance to a yard or a dead end alley along with a road sign indicating a dead end;
  • at checkpoints and entrances to the official territory of various organizations and enterprises.

Plates 8.3, which can be added to the traffic sign "Movement is prohibited"

Sign 3.2 may be supplemented by signs 8.3.1-3 with arrows indicating the direction of the zone of action of the prohibition sign, and 8.5.1-4 indicating the days and times of its operation.

So, for example, this “Movement is prohibited” sign with a traffic direction sign prohibits the movement of vehicles in the direction of the arrow.

No traffic sign for trucks

The sign at number 3.4, which is a white disc with a red border and a black silhouette of a truck, has the name in the SDA “Trucks are prohibited”. It prohibits passage on the established section for all trucks whose curb weight is more than 3.5 tons. If, on the sign in the silhouette of the car, the value of the load capacity is indicated (for example, 8 tons), then it indicates the maximum allowable weight of an equipped truck that is allowed travel.

Road sign "Movement prohibited" for trucks

Just like the previous sign, it has exceptions for a certain category of cars. Its action does not apply to trucks adapted for the transport of people, postal service vehicles and special vehicles of enterprises and organizations located on this site. As in the case of sign 3.2, here it is also possible to enter the specified category of cars only from the side of the nearest intersection relative to the destination.

Road sign prohibiting the movement of mechanical transport

The sign at number 3.3, which is a white disk with a red border and a black silhouette of a passenger car in front, is referred to in the Rules as “Motor Vehicles are Prohibited”. t in the established territory the passage of all types of mechanical transport. Motorized vehicles include any motorized vehicle powered by an engine, with the exception of a moped. They also include tractors, all-terrain vehicles, self-propelled devices.

Road sign 3.3

The ban does not apply to mopeds and the same types of transport that are listed in the exception for sign 3.2 - postal and disabled cars, public routes, official and personal cars of organizations and citizens working or living in the territory where the traffic ban is established. In fact, it repeats all the requirements of the "Movement is prohibited" sign. The difference between this sign and sign 3.2 is that it allows movement for mopeds, bicycles, horse-drawn vehicles.

Exception to the rule

  • public transport, the route of which passes through the territory where the ban has been introduced;
  • cars driven by people with disabilities, having disabilities of 1-2 groups, or carrying them. In this case, the car must be equipped with an identification mark "Disabled";
  • official vehicles serving organizations and firms located in the restricted area;
  • personal cars, the owners of which live within the territory where the movement of cars is prohibited;
  • special vehicles of postal organizations, which must have a blue color scheme corresponding to this service with a white diagonal stripe.

Penalty for driving under the sign "Movement is prohibited"

Despite the high importance in ensuring traffic safety on the roads, in terms of the degree of responsibility for violation of requirements, the sign occupies one of the last places. For non-compliance with the requirements of the sign of Art. 12.16 Part 1 of the Code of Administrative Offenses provides for a minimum administrative fine in the amount of 500 rubles. This is due to the low probability of serious consequences for other road users due to violation of the requirements of the established sign.

Article 12.16 part 1 of the Code of Administrative Offenses of the Russian Federation:

1. Failure to comply with the requirements prescribed by road signs or markings on the carriageway, except for the cases provided for by parts 2-7 of this article and other articles of this chapter, - entails a warning or the imposition of an administrative fine in the amount of five hundred roubles.

If you drove under, then in order to avoid a fine, in no case do not allow through passage through a prohibited area.   • drivers of official vehicles serving organizations in the given territory - a consignment note or a ticket indicating the address;
  • employees of enterprises located in a prohibited area - a service certificate;
  • a car serving disabled people must have an identification mark established by the Rules, and disabled people themselves must have a certificate of a disability group;

Violation entails administrative liability in the form of a fine or a warning (part 1 of article 12.16 of the Code of Administrative Offenses of the Russian Federation).

There are also exceptions in the law that allow certain categories of citizens to pass under the sign, without subsequent penalties.

What the traffic rules say

Responsibility for violation of the sign 3.2 of the traffic rules is provided for by the administrative code. So, ignoring this rule entails liability in the form of a fine of 500 rubles or a warning (part 1 of article 12.16 of the Code of Administrative Offenses of the Russian Federation).

Appearance

Sign, 3.2 "no traffic", round, with a red border on a white background. Made using reflective paint (GOST 9.401-91).

Area of effect

A traffic prohibition sign begins at the installation site and ends at the nearest intersection following the direction of travel.

Usually, in practice, a road sign is installed in tandem with indicating signs in the form of arrows (8.3.1-8.3.3 SDA), indicating the direction in which it is forbidden to drive.

Who is allowed to move despite the ban

  • Citizens, the road to the house, which is marked with a sign (must have a passport with a residence permit at the address that matches the area where the sign is valid);
  • Postal service, whose machine must be marked with a white stripe on a blue background;
  • Special organizations that control and maintain facilities located in the area of the sign (required documents confirming the need for travel, such as a waybill);
  • Public transport following the route, which is certified by the city administration and agreed with the traffic police;
  • Cars of citizens with disabilities of groups 1 and 2 (you must have a sticker on the car indicating disability and documents confirming the diagnosis);
  • Cars transporting people with disabilities, as well as children with disabilities;
  • Serving transport of enterprises located in the area of the sign (these may include heavy vehicles transporting consumer goods to a store located in a specified location). The driver must have documents, an invoice or a waybill with him, otherwise the inspector may be fined for a violation;
  • Rescue services, emergency aid, fire protection, specialized vehicles of the Ministry of Emergency Situations.
IMPORTANT! Drivers who are allowed to ignore the presence of a white circle with a red border should leave the sign's area as quickly as possible at the nearest intersection.

Penalty for driving under the sign

According to the Code of Administrative Offenses, movement in the field of action of the sign entails a fine of five hundred rubles or a warning.

In cases where a citizen violates for a good reason, he must have with him documents confirming the preferential category of citizens. Or evidence of involvement in an organization servicing an object located in the area of the sign, otherwise the driver faces a fine of 500 rubles.

In cases where the driver chooses a route to bypass traffic jams, passing under the sign and turning into a through passage through a residential area, the fine increases to 1,500 rubles (Code of Administrative Offenses of the Russian Federation, article 12.28).

For heavy vehicles of the preferential category, a recommendation is provided to enter the zone of action of the sign only along the shortest path and from a side intersection. If this condition is not met, then, regardless of the exceptional category, a fine is provided that is not subject to appeal.

IMPORTANT! Taxi with an identification coloring, and documents confirming the occupation of the carriage, when transporting passengers, do not receive a fine for travel under the sign 3.2 of the SDA. Since they are equated at the time of employment, to public transport.

Special cases

Signs prohibiting passage can be of several types. So, a white round sign with a red rim and a painted truck inside means that only trucks are prohibited from passing. Usually in the center of this sign is indicated the tonnage of the vehicle, heavier than which movement is prohibited. This sign is also subject to exceptional cases allowing passage.

When driving under the sign into the residential area of a private car, the inspector has the right to demand documents for verification. In this case, the driver must provide rights, insurance, and a passport with a residence permit at this address.

If the registration is not at the place of entry, then the inspector issues a fine, provided that the driver is not disabled and has supporting documents and a sticker on the car.

When installing a sign prohibiting movement, usually a detour indicator is set a few meters away, with the direction in which the driver should move. The traffic ban area ends after the first intersection.

How is it different from a no entry sign?

A no-entry sign, round with a red background, with a white horizontal rectangle placed in the center. Colloquially referred to as a brick.

Movement within the area covered by this sign is prohibited. The exception is route modes of transport. However, when drawing up routes for buses and other vehicles carrying passengers, it is necessary to coordinate the route with the traffic police. Therefore, in practice, such an exception to the rule is extremely rare.

Where the sign "brick" is installed: entry is prohibited:

  • The entry is prohibited sign, it is installed on sections of roads where it is necessary to adjust the direction of movement. For example: on a one-way road, but provided that it is installed against the permitted direction;
  • On a specially designated lane for public transport. It means that except for passenger buses, no one is allowed to move along the marked road;
  • In areas where there is a separation of entry and exit of vehicles. For example, a closed area of the plant, where control-inspection of trucks is carried out;
  • At high-risk facilities where it is necessary to organize one-way traffic in order to reduce the risk of accidents. For example, a gas station, or an area with heavy foot traffic, as a recreation center.

Where is the "no traffic" sign posted?

  • Before the start of the section with emergency pavement, and its repair;
  • On the border of the pedestrian zone;
  • On sections of the road where the lane is intended only for route vehicles.

There are differences in the punishment for non-compliance with the rules. So if, for driving under the sign 3.2 of the SDA, a penalty of 500 rubles is provided, then for driving under the sign 3.1 of the SDA “entry is prohibited”, a fine of 500 rubles is provided if the violation occurred outside the carriageway, for example, a gas station. In case of violation on the road, the fine increases to 5,000 rubles or deprivation of rights for 4-6 months, depending on the circumstances. In case of a repeated incident, recorded by a camera of 5,000 rubles, but when stopped by an inspector, the driver can expect a deprivation of rights for 1 year.

Reading time: 3 minutes

You need to know the rules of the road (SDA). They not only prohibit violations on the road, but also provide certain rights. Prohibition signs do not apply to all drivers and modes of transport. The sign "Movement is prohibited" in the basic rules for the driver, it has the number 3.2 and is a white circle with a red rim. We will tell you what it prohibits, who it does not apply to, and what the fine is in 2020 for entering under the “Movement is prohibited” sign.

What the regulations say

The main laws for the driver are concentrated in the Rules of the Road. However, there are other regulations of the Russian Federation that directly determine the order of movement on the roads. In this case, this is the state standard (GOST).

Specifically, “Movement is prohibited” is related to GOST R 52289-2004. Paragraph 5.4.3 of this document states that this sign on the road is used when it is necessary to impose a ban on traffic on certain sections of the road. In the same document, paragraph 5.4.29 speaks of the need to install this image on all possible entry routes to the territory where there are restrictions and on which it is impossible to move in vehicles.

Traffic rules determine that it is impossible to move in the area of this road image in both directions. Thus, it should not be used on roads with only one-way traffic.

Which vehicles are subject to the "Movement is prohibited" sign

It applies to vehicles of any type. Drivers should be aware that they will be punished for illegal entry under sign 3.2. In this case, this is a fine, the size of which we will discuss below.

However, like many prohibition signs, "Movement is prohibited" provides for a fairly significant list of vehicles to which it does not apply. What are the exceptions?

Who can pass under the sign "Movement is prohibited"

The list of those who can safely enter inside a limited area is quite large. It is established by GOST R 52289-2004. Paragraph 5.4.30 of this document indicates for which groups of persons and vehicles "Movement is prohibited" does not apply.

May enter:

  1. People living in the territory within the scope of the sign.
  2. Disabled drivers of group I or II, as well as drivers carrying persons of these groups or disabled children.
  3. Persons working inside the zone on personal transport.

What vehicles are allowed to enter:

  1. Shuttle transport, if the restricted area is on the established route.
  2. Transport that serves enterprises and their employees inside the "Movement is prohibited" zone.
  3. Transport of the state postal service, if it is indicated by a white oblique stripe on a blue background.

Naturally, the right to such a journey, if necessary, must be confirmed, otherwise, at best, you will have an unpleasant conversation with the traffic police.

What documents confirm the right to move in the zone of action "Movement is prohibited":

  1. Residents of the area covered by this sign must have a passport with the appropriate place of registration.
  2. Drivers who serve the enterprises of this zone or deliver goods to them are required to have a voucher or invoice, which indicates the address within the zone of its operation.
  3. Employees of enterprises in this zone also need something to confirm the fact of working in it. In particular, you can carry an employment contract with you.
  4. If the driver is disabled, his vehicle must be marked with an appropriate sticker. You must have documents confirming the fact of disability.

Differences from the road sign "No Entry"

There is a similar road sign 3.1 "No Entry". Outwardly, it looks like “Movement is prohibited”, only with an inscribed red circle in the center of which there is a white rectangle. For this addition, it is often referred to as a "brick". But what is its main feature?

Sign 3.1 is more strict and assumes the presence of a real danger inside its zone, in particular, it is installed before entering road sections with oncoming one-way traffic. Only passenger transport, the route of which runs through this territory, is allowed to enter the territory of its operation.

What sanctions are expected for violation

Violation of traffic requirements, even if it did not entail any consequences, is a serious administrative offense. Responsibility for such violations in the Russian Federation is provided for in the Code of Administrative Offenses (CAO) No. 195-FZ dated December 30, 2001 (as amended on August 3, 2020). Article 12.6 of the Code of Administrative Offenses establishes that a warning or a fine is due for such an offense.

If you are stopped by the traffic police in a prohibited area, behave calmly and politely. Apologize, say that you did not notice the ban, explain why you need to go here.

If your explanations do not satisfy the traffic police, you will have to pay a fine. For driving under the sign "Movement is prohibited" in 2020, the fine is 500 rubles.

If you think you have been wrongfully punished

When you have been fined illegally or erroneously, try to challenge the decision by contacting the traffic police authorities or in court. In both cases, it is better to involve a qualified lawyer in the case.

If you agree with the fine decision, try to pay it on time. The presence of unpaid fines can lead to various unpleasant consequences up to the refusal to travel abroad. You have 70 days to pay the fine. Ten of them are given to appeal the decision.
