From April 4, 2017, there are changes in the road rules in Russia that relate to the presence of the “Spikes” sign on cars. Drivers suddenly had to remember about the triangle with a capital letter “Sh”, which, it seems, was not even always talked about in post-Soviet driving schools. And, therefore, it makes sense for all of them to literally stay away from you - that is, at an increased distance, so that in the event of your sudden braking, they simply do not crash into your ass.
In addition, since studded tires are still available in varying quality, studs coming out from under the wheels of vehicles in front is still a common occurrence. So, fellow travelers behind you should be warned: if they do not want to get a solid object identical to the notorious “pebble” in the windshield, then again they should keep at a more respectful distance.

Yes, it's a must now. By government decree (No. 333 of March 24, 2017), the absence of the “Spikes” sign is included in the number of malfunctions in which the operation of the vehicle is prohibited. Now about the seasonal factor. The only rule you need to know is that the “Spikes” sign on your car must appear in sync with the appearance of studded wheels on it. However, it is worth remembering that the operation of summer tires in Russia is legally prohibited from December to February, as, by the way, riding on spikes from June to August inclusive. The rest of the time is a period that is at the discretion of the driver himself, who must be guided by weather conditions. The question is not idle, given that now, in the wake of the general excitement, the “Ships” sign has become a real deficit, and its cost sometimes even exceeds the very 500 rubles that will have to be paid for its absence. The requirement for the presence of the “Spikes” sign on the car applies to all drivers without exception. But the fact is that this is not the only sign that, by the mentioned 333rd government decree, has become mandatory for the admission of vehicles to operation. Starting from April 4, 2017, the car cannot be operated if, depending on the circumstances, the signs are also missing: “Road train”, “Transportation of children”, “Deaf driver”, “Training vehicle”, “Speed limit”, “Dangerous Cargo”, “Oversized Cargo”, “Slow Vehicle”, “Long Vehicle” and “Beginner Driver”.
Most of these signs are special. For example, the sign "Transportation of children" applies only to buses, and "Long-length vehicle" - as a rule, is hung on freight transport. It is important to pay attention to the “Beginner Driver” sticker if your driving experience is less than two years. There are rules according to which motorists must stick mandatory symbols on the rear or front glass of the car, as well as on the body. These types include the symbol indicating the presence of studded tires on the car.

According to the 2018 traffic rules governing traffic, the sticker must be visible to all drivers on the road, so each side of the triangle with the Ш sign must not be less than 20 centimeters, and the framing border must not be less than 2 centimeters.

Where to glue the spikes information sign?
The location of the Ш symbol on the car is not clearly regulated by the rules for the operation of cars:
- According to paragraph 8 of the Basic Provisions, this sticker should be placed just behind the car, that is, not necessarily so that it is clearly visible to other drivers moving behind. Depending on the brand of car, the location of the sticker can be adjusted.
Experienced driving school instructors advise sticking a similar marking at the top of the rear window - according to them, in such a place the symbol is best visible to other road users. You can choose any side of gluing - the main thing is that the symbol is clearly visible and does not interfere with the view of the motorist.
In the case of a tinted rear window, it would be better to place the sticker on the outside. Transparent glass does not prohibit and allows its location from the inside. It would be better if it was located where the glass is cleaned of adhering snow mass with a janitor or brush. It can also be placed on the body or bumper.
This sticker can be purchased ready-made in the store, or you can make it yourself on thick photo paper. To stick the symbol, the best solution would be a suction cup, as it will not leave marks on the glass after removal, unlike adhesive tape. You should be aware that ready-made stickers in stores often do not comply with the conditions of traffic rules, and installing a sign that is too small will not have legal force, but it will be quite difficult to fine a driver for non-compliance. In addition, ready-made stickers with a sticky layer cannot be reused, and noticeable adhesive marks will remain on the glass after use.

What is the penalty for not having a sticker? Many people are concerned about the question, is there a penalty for the absence of the Thorns sign?
- Legislation, in accordance with clause 8 of the Basic Provisions, requires that vehicles equipped with studded tires have the Spike sign.
- In addition, according to clause 2.3.1 of the Rules, each driver is obliged to ensure the technical serviceability of the car in accordance with the above document.

According to the Code of Administrative Offenses, at the moment there is a fine for the absence of a Spikes sticker, traffic police inspectors can punish the car owner under Part 1 of Art. 12.5 - this entails either a warning or an administrative fine of 500 rubles.
Previously, the driver could challenge this decision in higher authorities, since Article 12.5 did not provide for malfunctions, which include paragraph 8 of the Basic Provisions. In 2017, a change was made to clause 8 and the absence of this sign is a malfunction that prohibits movement.

Responsibility in case of an accident
Ignoring the reasonable requirements of the law, you need to be prepared for negative consequences. In the capital and the region, there was talk among motorists that traffic police inspectors began to issue a fine for the absence of the “Spikes” sign in the amount of 500 rubles. The sign, which is a white equilateral triangle with a red border and installed with the apex up, has a contrast image of the letter “Ш” in black in the center. This requirement is caused by the need to ensure traffic safety on the roads in winter, when the stopping distance of cars is lengthened by reducing the adhesion of tires to the road surface. On the legality of the fine for the absence of the sign "Spikes"

Until April 4, 2017, the fine for the “Spikes” sign issued by traffic police inspectors in the amount of 500 rubles on the basis of Article 12.5 part 1 of the Code of Administrative Offenses of the Russian Federation was illegal. This paragraph of the law literally states what can be applied in the amount of 500 rubles. Namely, it is applied when there is a fact of driving a car, the operation of which is prohibited.
In the detailed List of malfunctions and conditions that prohibit the operation of vehicles, attached to the Regulations, there was no such item as a prohibition to leave without an installed “Spikes” sign. It turns out that the law obligated drivers to install the “Sh” sign on the car if there were studded tires on the wheels, but did not prohibit its operation without this sign. Consequently, the inspectors' reference to Art.12. Part 1 of the Code of Administrative Offenses and the charge of an administrative penalty of 500 rubles was unreasonable, and it could be challenged in accordance with the established procedure. In fact, earlier the need for the “Sh” sticker was advisory in nature.
In addition, it can be noted that not a single legislative act specifically specified the requirements for the order and place of installation of the sign. There was only his description and the general requirement that he should be at the back of the car. Car accessories stores sell ready-made sticker signs that sellers recommend sticking to the upper or lower corner of the rear window from the inside. However, it should be noted that in adverse weather conditions, these places are most often covered with snow, mud and are outside the wiper's reach. That is, these are not the best places to install a sign. In addition, if the rear window is tinted, then the sign should be stuck on the outside of the glass, which significantly reduces its service life.

On April 4, amendments to the traffic rules, signed by D. Medvedev on March 27, 2017, came into force. More precisely, two government decrees were signed: dated March 24, 2017 No. 333 “On Amendments to the Resolution of the Council of Ministers - Government of the Russian Federation dated October 23, 1993 No. 1090” and dated March 23, 2017 No. 326 “On Amendments to the Rules for Passing Examinations for the Right to Drive Vehicles and Issuance of Driving Licenses”.
According to the decree of March 24, the "List of malfunctions and conditions under which the operation of vehicles is prohibited" was supplemented by paragraph 7.15.1 - the absence of the "Spikes" sign. That is, now the absence of this sign on the glass is qualified as a malfunction in which it is forbidden to operate the vehicle, and the inspector, on the basis of part 1 of article 12.5 of the Code of Administrative Offenses, can impose a fine of 500 rubles. But the inspector has no right to detain the vehicle and send the car to the impound lot.
By the way, this sign is not the only one that, under certain conditions, must be displayed by the driver. For example, there is a yellow square with an exclamation mark in the middle, called "Attention, novice driver!", Which must also be displayed behind the car by a driver with less than 2 years of driving experience. Now, for the absence of the “Beginner Driver” sign, a fine of 500 rubles is also imposed.

Now, the Ministry of Internal Affairs believes that there are other criteria for determining the threat: the design of the car, whether it is loaded or empty, how modern the braking system is, as well as weather conditions and the condition of the road. Probably, it is for them that the driver moving behind must calculate the braking speed of the driver in front of him. Recall that before the sign was canceled, a fine was even introduced for its absence in the presence of studded tires - 500 rubles.
Important! The sticker limited the view, and if there are several of them, for example, “newbie driving”, “disabled”, “child in the car”, then the rear window turns into an art gallery.
Interestingly, after the journalists began to calculate when the spike sign on the car would be canceled, several high-profile articles were published in parallel, which talked about speculation with stickers. Izvestia, for example, told that the Movement of Motorists of Russia insists on checking and finding the one who "snatched the jackpot" and earned fortunes on the rush demand and sky-high 150 rubles for a triangular piece of paper.
Since when is it allowed to move without a sticker?
The fine for the absence of the “Spikes” sign in the traffic police department was canceled in the fall of 2018, since during this period the Government was already considering a law that, in principle, abolishes the need for a triangular sticker on the rear window of a car. November 24, 2018, when Prime Minister Dmitry Medvedev signed and approved the relevant law, is considered the official date for permission to move a car without the “Spikes” sign. However, on the traffic police website, we can see a different date - 12/8/2018. This is due to the fact that the term of the Federal Law begins with a two-week prolongation. Interestingly, this Decree includes some other innovations.
- A car with a "Disabled" sign can be parked anywhere, even in an area where parking is prohibited. Wheelchair users are considered pedestrians whether or not their vehicle is powered.
- The algorithm for issuing traffic rules by traffic police now complies with the Europrotocol
The fact that the "Ships" sign is no longer needed is also indicated by the official interpretation of paragraph 8 on the Consultant Plus website.
On a note! If, nevertheless, you want to warn drivers that studded tires are installed on your car, then you have every right to do so - you can hang a sticker, no fines or sanctions will follow.
The reaction of car owners
Many drivers agree with the cancellation of the sign, believing that the braking distance of modern cars should be assessed differently, and the sticker closes the review. But there are others who still see the obsolete sticker as necessary. In their opinion, the sign serves as a good and clear warning - you need to keep the maximum possible distance with this car, otherwise you risk damage to the windshield and body of your car. Well, at the moment, every motorist has the right to decide on his own whether to stick a long-suffering sticker on the rear window of his vehicle or not.
